A Public Hearing was held by the Town of Moreau Town Board on August 8, 2006 in the Town of Moreau Office Building, 61 Hudson Street, South Glens Falls, New York, for the purpose of considering the adoption of Local Law No. 2 of 2006, which if adopted would modify the schedule of Regulations of the Town of Moreau Zoning Law to increase the maximum structure height of one family and two family residential dwellings from thirty (30) feet to thirty-eight (38) feet.

Supervisor Gutheil opened the Public Hearing at 6:50 p.m.

The Town Clerk read the following Notice of Public Hearing that was published in the legal ad section of the Glens Falls Post Star Newspaper on July 29, 2006:

NOTICE OF PUBLIC HEARING

TO CONSIDER

ADOPTION OF LOCAL LAW

NOTICE IS HEREBY GIVEN pursuant to Section 20 of the Municipal Home Rule Law and Section 264 of the Town Law that the Town Board of the Town of Moreau shall conduct a Public Hearing at the Moreau Town Hall, 61 Hudson Street, South Glens Falls, New York on Thursday, August 8, 2006 at 6:50 p.m. for the purposes of considering the adoption of Local Law No. 2 of 2006. Local Law No. 2 of 2006 as proposed modifies the Schedule of Regulations of the Zoning Law of the Town of Moreau to increase the maximum structure height of one family and two family residential dwellings from thirty (30) feet to thirty-eight (38) feet. A copy of the proposed Local Law No. 2 of 2005 can be obtained at the Town Hall.

The Town Clerk acknowledged receipt of a letter from the Assistant Fire Chief of the South Glens Falls Fire Company, Timothy A Johnston, indicating that they approve of the proposed increased building height of thirty-eight (38) feet.

The Town Clerk also acknowledged receipt of two letters from the Saratoga County Planning Board. One in which they approved of the Town Board assuming lead agency status in the State Environmental Quality Review (SEQR) for this action. In the other letter they indicated that they had received a referral from the Town Board regarding this proposed local law and that they had reviewed it and found that this proposed action does not have any significant county wide or inter community impact.

Supervisor Gutheil asked if anyone present wished to be heard for or against the proposed local law.

Elizabeth Garcia from 470 Old Saratoga Road spoke in favor of the proposed building height of thirty-eight (38) feet. In her opinion it suits the new style of homes better and it supports the community in multiple aspects. She felt it would be a good decision to adopt this local law.

Supervisor Gutheil asked if anyone else wished to be heard for or against the proposed local law.

There was no response.

Councilman Kusnierz questioned whether or not the letter from the South Glens Falls Fire Company approving of the thirty-eight foot building height should have been signed by the Fire Chief and not the assistant?

Supervisor Gutheil explained how there has been a recent change in Fire Chief and that may be why the letter came from the assistant.

Supervisor Gutheil advised that they could keep the public hearing open for now and obtain a letter from the Fire Chief and then it could be entered into the record of the public hearing.

There being no one else who wished to comment Supervisor Gutheil adjourned the public hearing at 6:58 p.m. stating that it would be kept open. until they received a letter from the Fire Chief.
