A month-end meeting of the Town Board of the Town of Moreau was held on August 28, 2003 in the Town Office Building, 61 Hudson Street, South Glens Falls, New York.
The month-end audit meeting is usually held at 3:30 p.m. to meet with Department Heads to go over vouchers presented for audit and at 4:00 p.m. the business portion of the meeting is normally commenced.
At 3:30 p.m. a quorum of the board was not present. Only Supervisor Gutheil and Councilwoman Baker were present.
Also present were Mike Shaver, Water Superintendent; Steve Barody, Highway Superintendent; Stephen Gram, Recreation Director; Joe Patricke, Building Inspector and Code Enforcement Officer; and Jeanne Fleury, Town Clerk; and guests.
An informal discussion ensued between Supervisor Gutheil and Councilwoman Baker and the Department Heads present regarding vouchers.
Vouchers 1319 and 1310 were pulled from the audit. Voucher 1310 was from IBS Septic for rental of port-o-potties for the period of 8/20-9/20/03. Part of the voucher was for services in advance and the Town does not pay in advance for services. The voucher will be put through next month.
Joe Patricke discussed with Supervisor Gutheil and Councilwoman Baker the need to transfer funds into the Building Inspector, Zoning and Planning Accounts to cover negative balances that will result if these transfers are not made and the vouchers that are in for audit are paid. (Amended 9/25/03 jf) The negative balances are due to legal services rendered and that were charged against these accounts when there wasn’t enough money budgeted. Joe Patricke would review the information provided by the bookkeeper and make a recommendation to the Board on where the money should be transferred from and how much to cover them through the end of the year.
At 4:08 p.m. the Department Heads left.
At 4:35 p.m. Councilman Kusnierz arrived making a quorum of the board. Supervisor Gutheil opened the month-end audit meeting and asked the Town Clerk to call the roll.
The Town Clerk called the roll, which resulted in the following Town Board Members being present or absent:

Supervisor Gutheil advised Councilman Kusnierz that some vouchers were discussed informally with the Department Heads who were present earlier.
Supervisor Gutheil advised that they had the Woodscape Lighting District Order to act on and as far as the Truck Route Proposed Local Law he felt there should be a full board present to discuss that.
It was discussed whether to call a special meeting or recess this meeting.
Councilman Kusnierz said he would like a full representation of the board, but his concern was over the school year that was about to start and something should be in place with the truck route before that.
Supervisor Gutheil advised that Dave Segal from Borden Chemical was present earlier in the meeting inquiring about the posting of roads.
Supervisor Gutheil asked for an Executive Session due to threatened litigation.
Councilwoman Baker made a motion to go into Executive Session at 4:40 p.m. to discuss threatened litigation and it was seconded by Councilman Kusnierz.

The Town Clerk did not sit in on the Executive Session.
A motion was made by Councilman Kusnierz and seconded by Councilwoman Baker to adjourn the Executive Session at 5:15 p.m. and re-open the month-end audit meeting.

No action was taken as the result of the Executive Session.
Supervisor Gutheil said they had to take action on an Order to create a Lighting District. He asked the Town Clerk to read the order and she did as follows:

ORDER REGARDING PROPOSED
LIGHTING DISTRICT
WHEREAS, the Town Board of the Town of Moreau was presented with a petition pursuant to Town Law Article 12 for the establishment of a Lighting District located in the Woodscape Subdivision on the south side of Reservoir Road, Town of Moreau, Saratoga County, State of New York to be known as the Woodscape Lighting District; and
WHEREAS, the petition was filed by the owner/developer of taxable real property located within the proposed lighting district; and
WHEREAS, according to Niagara Mohawk Power Corporation a total of fifteen (15) one hundred watt high-pressure sodium lights will be installed in the lighting district; and
WHEREAS, according to Niagara Mohawk Power Corporation the lights will be no higher than sixteen feet and will be architectural in design; and
WHEREAS, according to Niagara Mohawk Power Corporation the yearly billing charge for the aforesaid one hundred watt high-pressure sodium lights is approximately $4,717.92; and
WHEREAS, no dollars are proposed to be expended for improvements; and
WHEREAS, the Town Board of the Town of Moreau shall meet on September 11, 2003 at 6:50 p.m. to consider the aforesaid petition and to hear all interested persons.
NOW, THEREFORE, by Resolution of the Town Board of the Town of Moreau, it is hereby ordered;
1. That the Town Board shall meet at the aforesaid time and place to consider the petition for the creation of the lighting district within the Woodscape Subdivision; and
2. A copy of the Order, certified by the Town Clerk, is to be published at least once in the Post Star, the first publication thereof to be not less than ten (10) and no more than twenty (20) days before the day set herein for the hearing as aforesaid; and
3. A copy of this Order shall be posted on the sign board at the Town of Moreau Town Hall not less than ten (10) and no more than twenty (20) days before the day designated for the hearing as aforesaid; and
4. A detailed explanation of how the estimated costs were computed is available for public inspection with the Town Clerk.

Supervisor Gutheil asked for the record to indicate that the month-end meeting would be rescheduled. There are some serious issues to deal with and the full board should be involved.
Supervisor Gutheil said some of the vouchers could be approved for payment, but then there would be two warrants and some of them need dialogue due to threatened litigation and some involve long standing disputes and there is a settlement offer on one of them.
A motion was made by Councilwoman Baker and seconded by Councilman Kusnierz to adjourn the month-end audit meeting at 5:20 p.m.
