A regular meeting of the Town Board of the Town of Moreau was held on July 8, 2003 in the Town Office Building, 61 Hudson Street, South Glens Falls, New York.
Supervisor Gutheil called the meeting to order at 7:00 p.m.

MINUTES – JUNE 30, 2003 – MONTH-END AUDIT MEETING:
Comment: Supervisor Gutheil referred to Page 271, the 2nd paragraph from the bottom, that mentioned about bills the Highway Department submits to be reimbursed for manpower and labor provided to other departments. Supervisor Gutheil thought the minutes should reflect that the Highway Department does work for other departments and some they charge and others they don’t.
Page 275 – "Fran Thibodeau prepared and distributed to the Board a list of budget transfers that she made within the contractual portion of accounts that had negative balances." Change the words "that had negative balances" to "that would have had negative balances".

MINUTES – JUNE 30, 2003 – WATER COMMITTEE MEETING:
These minutes were received and filed.
FUTURE MEETINGS:
Supervisor Gutheil spoke about the proposed dredging and dewatering facility that the EPA is proposing and an inquiry he had received from a person about opening a landfill in the Town of Moreau. He stated that the Board needs to get back to work on the proposed Waste Law.
A special meeting of the Town Board to discuss the proposed Waste Law was scheduled for 5:00 p.m. on July 15th.
The Month-End Audit Meeting was scheduled for July 31st at 3:30 p.m. to discuss vouchers with Department Heads and 4:00 p.m. for the business portion of the meeting.

DEPARTMENT HEAD REPORTS:
A motion was made by Councilwoman Baker and seconded by Councilman Kusnierz to receive and file monthly reports from the Supervisor, Recreation Director, Highway Superintendent, Building Inspector, Assessor, Dog Control Officer, and Town Clerk.
Comments: Supervisor Gutheil noted on the Dog Control Officer’s Report that he has been answering several complaints from the same residences and the complainants refuse to sign a complaint. He wondered how many times the Dog Control Officer should answer verbal complaints from the same complainant? He will discuss the procedure with Ed Hazelton, Dog Control Officer.
Supervisor Gutheil asked Steve Barody about the hauling of rubble that was mentioned on his report and where it was coming from? Steve Barody replied that it was coming from Jointa Lime to the Highway Department Yard. They are stockpiling it for use on road projects.
Supervisor Gutheil asked Stephen Gram to include in his reports safety checks that are performed at the Recreation Park. He also mentioned that one of the wrought iron benches near Field 1 was in need of repair, it is wobbly.
Supervisor Gutheil asked who fixed the potholes in the park and Stephen Gram replied that his staff did. Discussion followed on the golf cart and the repairs that have been made to it. Stephen Gram advised that it was not running again.
Supervisor Gutheil asked Stephen Gram to make sure that people don’t misconstrue certain programs for rec. programs when they are not.
Brief discussion followed on the Pow Wow that was held in the park over the 4th of July weekend. A certificate of insurance was not provided to the Town by the coordinators of the Pow Wow and it was the consensus of the Board that in the future a certificate of insurance is to be provided to the Town or else a permit to use the park will not be issued. Stephen Gram was asked to notify the coordinators of the Pow Wow of this in advance of next year’s event.

MINING PERMITS:
Two Town Mining Permit Application Renewals were received and presented to the Town Board for approval. One was from D.A. Collins for the Old Shaw Pit on Route 9 where it intersections with South Road and the other was Peter Barden on Washburn Road.
The Town Clerk advised that Joe Patricke, Building Inspector would be a little late getting to the meeting, but he advised her earlier in the day that he had inspected both operations and found that the Town Mining Permits could be renewed.
A motion was made by Councilman Prendergast and seconded by Councilman Hewlett authorizing the renewal of the Town Mining Permits for D. A. Collins (the Old Shaw Pit) and Peter Barden.

CRANDALL LIBRARY REQUEST:
A request was received from the Crandall Public Library to use the Town Hall to hold a Public Hearing on their Proposed Budget for the Year 2004 on October 9th at 7:00 p.m. The Town Board did not have a problem with this request.
Supervisor Gutheil mentioned a resolution passed by the Library Board of Trustees which indicated they solicited comments from Queensbury, Glens Falls and Moreau. We haven’t been solicited. The resolution that was adopted established that the Board of Trustees would be made up of four members from Glens Falls, four from Moreau and seven from Queensbury. Enabling legislation was set up, to be adjusted by census population. Therefore, as our population expands we may be able to increase our representation on the Board. There is currently a vacancy on the Board of Trustees and his would be a good opportunity for someone from Moreau to run for the position at election time and represent the Town.
BUDGET AMENDMENT:
At the Month-End Audit Meeting, C.T. Male was authorized to sample the old water filters being stored at the old water plant for contaminants. It was noted at that time that a budget amendment might be needed to pay for this and the possibility of paying for this out of the GE/Moreau Account. Supervisor Gutheil has since checked the GE/Moreau Line Item in the budget and there wasn’t any money budgeted for 2003 and we probably don’t need one, because that lawsuit is settled. He thought it might be more appropriate to pay for this out of general engineering, A1440.411.1, there is $2,000.00 in that account. The Board didn’t have a problem with this. A budget amendment is not needed.
SOCCER UNIFORM BIDS:
Bids for Soccer Uniforms were received and opened at 3:05 p.m. on July 7, 2003. Stephen Gram reviewed the bids and recommended that an award be made to Score the low bidder as follows: Bid 1
includes shipping on initial order – Youths $15.23 and Adults $16.53 each.Bid 2 shipping is $345.00 for main order – Youth $14.65 and Adults $15.95
A motion was made by Councilwoman Baker and seconded by Councilman Kusnierz to accept Bid #2 from Score.

ENGINEERING REVIEW & OBSERVATION (EXTENSION 1-
WATER DISTRICT 5):
Proposals were received from EDP and Burley & Guminiak for Engineering Review & Observation for Extension 1 of Water District 5 as follows:
EDP Principal in Charge - $80.00 per hour
Observation - $55.00 per hour
Time and mileage will only be charged on inspection services
Travel time will be limited to ½ per day and mileage limited to 30 miles per day
Burley & Guminiak Review - $75.00 per hour
Observation - $45.00 per hour plus per diem on mileage
Supervisor Gutheil suggested waiting until the Board knows whom the contractor is going to be and for now award only the review of the construction documents. The Board didn’t have a problem with this.
A motion was made by Councilman Kusnierz and seconded by Councilman Hewlett to engage the services of Burley & Guminiak to review the construction documents for Extension 1 of Water District 5.

COMPUTERS:
Supervisor Gutheil stated he put computers on the agenda, because he has heard that two departments don’t have computers and one is the Assessor’s Office. He asked his staff to get some prices and they got some, but it needs further research. The same goes for the Building Inspector’s Office. There is no reason for this if there is money in the budget. The Assessor’s Budget has $1,400.00 for a computer and should be more than
adequate. The Building Inspector’s Budget has $1,200.00 for a computer, plus $500.00 in miscellaneous. The Assessor had already gotten one quote previously for $1,222.00. By the next meeting he asked both departments to gather quotes and present them to the Board for approval.LANDFILL POST CLOSURE MAINTENANCE & REPAIR:
As the result of our last inspection we do have some gas bubbles and there is some exposed liner. There wasn’t the amount of cover over the liner that should have been according to the specifications when it was built. This should be addressed with Stearns & Wheler. The report also said at a minimum the gas build up should be released at the bubble locations, the liner repaired and the required cover material reestablished over the repaired liner. We may also have to put in a supplemental gas vent. In the meantime, we have to get the animal burrows filled in. Last time the recreation department staff did this. C.T. Male offered to assist the Town in preparing the bid package and obtain quotes from contractors to address the gas bubbles. The Town Board did not object to this.
COMMITTEE REPORTS:
Councilwoman Baker reported she met with Supervisor Gutheil and three representatives regarding the lawn restorations and they will fax them a list of residences and they will go look at them and send back quotes. Watkins said that mid-August was the best time to plant grass seed.
Supervisor Gutheil reported that she met with Supervisor Gutheil and interviewed potential candidates to work as substitutes at the Transfer Station when John Hoey or Nancy Ryan is on vacation or sick leave.
Councilman Prendergast and Councilman Kusnierz reported on a Recreation Commission Meeting that they attended last night. There was some discussion about the Calico Dancers and insurance. The tile work in the bathrooms will be done soon. Removal of garbage after the Pow Wow was also discussed. There is a substantial amount of garbage created and this isn’t a Town run program yet the Town picks up the tab on this. Another issue was, because the park is open 24-hours a day during the three-day period perhaps only one entrance should be open so there is more control over who goes in and out. Stephen Gram said he did arrange to have the Sheriff’s Department patrol during this event. It was also discussed about having a rec. employee on duty around the clock during this event in the future. There was also vandalism. Someone tried to kick in the door to the handicapped bathroom and the lock to the little league building was cut. It is not known if this was done during the Pow Wow or not. Supervisor Gutheil suggested motion lights.
SUPERVISOR’S ITEMS:
Supervisor Gutheil reported that there was a PCB Meeting at the County today and they hired a firm to review the technical documents produced by the EPA and they have replied to the EPA with their comments. It is a good thing the County has this firm on board. They are finding things that could be critical to whatever town ends up with the dewatering facility and the project in general. George Hodgson who is on the Environmental Management Council did a nice job also commenting on these documents.
The Highway Superintendent requested permission to purchase asphalt concrete.
A motion was made by Councilwoman Baker and seconded by Councilman Hewlett approving the purchase of asphalt concrete, under county contract #03-PWAC-3R, at an amount not to exceed $200,000.00 from DB5112.493.4.

When the Department of Labor inspected the Transfer Station one of the violations they cited was the lack of a barrier around the propane tank. In an attempt to correct this violation proposals were solicited from contractors to erect a barrier. Adirondack Construction submitted a proposal in the amount of $4,500.00. It was the consensus of the Board that this proposal was excessive and they discussed ways of getting this done for less money. The Highway Superintendent suggested purchasing cement barriers to put around the tank. Supervisor Gutheil stated that if it appears this can’t be resolved by the date the violations are supposed to be corrected then he would be in favor of removing the tank altogether.
Supervisor Gutheil reported that Assemblywoman Sayward and Senator Little are sponsoring an Adirondack Park Statute of Limitations Bill and are looking for support from the Town. Someone bought a house in the park and after they bought it the APA visited the house and cited them for a deck that was in violation, but had been there 30 years. This legislation would put a 10 year statute of limitations on these types of things. Supervisor Gutheil stated he would like to look into this further and then the Board could decide if they wanted to support it.
Supervisor Gutheil reported receiving a statement from Banknorth on the Escrow Agreement, which is a three-contract. Somehow at the end of the three years he would like the Town to get custody of this money. There is $1,353,721.00 in the account. We are paying a fee for them to invest the money and it is eating up a lot of our interest. Attorney Auffredou suggested that Supervisor Gutheil start with GE and see where it goes from there.
Mike Shaver reported that the highest daily water usage so far has been 970,000 gallons.
Supervisor Gutheil reported receiving another telephone call from a credit company regarding an outstanding Tru-Green bill and he asked them not to call again and explained again to them that this is a disputed bill.
A motion was made by Councilman Hewlett and seconded by Councilman Kusnierz authorizing the hiring of Janelle Bashant as a Lifeguard at $7.50 per hour subject to successful completion of a pre-employment physical.

ENGINEERING REVIEW & OBSERVATION (EXTENSION 1-
WATER DISTRICT 5):
Proposals were received from EDP and Burley & Guminiak for Engineering Review & Observation for Extension 1 of Water District 5 as follows:
EDP Principal in Charge - $80.00 per hour
Observation - $55.00 per hour
Time and mileage will only be charged on inspection services
Travel time will be limited to ½ per day and mileage limited to 30 miles per day
Burley & Guminiak Review - $75.00 per hour
Observation - $45.00 per hour plus per diem on mileage
Supervisor Gutheil suggested waiting until the Board knows whom the contractor is going to be and for now award only the review of the construction documents. The Board didn’t have a problem with this.

COMPUTERS:
Supervisor Gutheil stated he put computers on the agenda, because he has heard that two departments don’t have computers and one is the Assessor’s Office. He asked his staff to get some prices and they got some, but it needs further research. The same goes for the Building Inspector’s Office. There is no reason for this if there is money in the budget. The Assessor’s Budget has $1,400.00 for a computer and should be more
than adequate. The Building Inspector’s Budget has $1,200.00 for a computer, plus $500.00 in miscellaneous. The Assessor had already gotten one quote previously for $1,222.00. By the next meeting he asked both departments to gather quotes and present them to the Board for approval.
LANDFILL POST CLOSURE MAINTENANCE & REPAIR:
As the result of our last inspection we do have some gas bubbles and there is some exposed liner. There wasn’t the amount of cover over the liner that should have been according to the specifications when it was built. This should be addressed with Stearns & Wheler. The report also said at a minimum the gas build up should be released at the bubble locations, the liner repaired and the required cover material reestablished over the repaired liner. We may also have to put in a supplemental gas vent. In the meantime, we have to get the animal burrows filled in. Last time the recreation department staff did this. C.T. Male offered to assist the Town in preparing the bid package and obtain quotes from contractors to address the gas bubbles. The Town Board did not object to this.
COMMITTEE REPORTS:
Councilwoman Baker reported she met with Supervisor Gutheil and three representatives regarding the lawn restorations and they will fax them a list of residences and they will go look at them and send back quotes. Watkins said that mid-August was the best time to plant grass seed.
Supervisor Gutheil reported that she met with Supervisor Gutheil and interviewed potential candidates to work as substitutes at the Transfer Station when John Hoey or Nancy Ryan is on vacation or sick leave.
Councilman Prendergast and Councilman Kusnierz reported on a Recreation Commission Meeting that they attended last night. There was some discussion about the Calico Dancers and insurance. The tile work in the bathrooms will be done soon. Removal of garbage after the Pow Wow was also discussed. There is a substantial amount of garbage created and this isn’t a Town run program yet the Town picks up the tab on this. Another issue was, because the park is open 24-hours a day during the three-day period perhaps only one entrance should be open so there is more control over who goes in and out. Stephen Gram said he did arrange to have the Sheriff’s Department patrol during this event. It was also discussed about having a rec. employee on duty around the clock during this event in the future. There was also vandalism. Someone tried to kick in the door to the handicapped bathroom and the lock to the little league building was cut. It is not known if this was done during the Pow Wow or not. Supervisor Gutheil suggested motion lights.
SUPERVISOR’S ITEMS:
Supervisor Gutheil reported that there was a PCB Meeting at the County today and they hired a firm to review the technical documents produced by the EPA and they have replied to the EPA with their comments. It is a good thing the County has this firm on board. They are finding things that could be critical to whatever town ends up with the dewatering facility and the project in general. George Hodgson who is on the Environmental Management Council did a nice job also commenting on these documents.
The Highway Superintendent requested permission to purchase asphalt concrete.

When the Department of Labor inspected the Transfer Station one of the violations they cited was the lack of a barrier around the propane tank. In an attempt to correct this violation proposals were solicited from contractors to erect a barrier. Adirondack Construction submitted a proposal in the amount of $4,500.00. It was the consensus of the Board that this proposal was excessive and they discussed ways of getting this done for less money. The Highway Superintendent suggested purchasing cement barriers to put around the tank. Supervisor Gutheil stated that if it appears this can’t be resolved by
the date the violations are supposed to be corrected then he would be in favor of removing the tank altogether.
Supervisor Gutheil reported that Assemblywoman Sayward and Senator Little are sponsoring an Adirondack Park Statute of Limitations Bill and are looking for support from the Town. Someone bought a house in the park and after they bought it the APA visited the house and cited them for a deck that was in violation, but had been there 30 years. This legislation would put a 10 year statute of limitations on these types of things. Supervisor Gutheil stated he would like to look into this further and then the Board could decide if they wanted to support it.
Supervisor Gutheil reported receiving a statement from Banknorth on the Escrow Agreement, which is a three-contract. Somehow at the end of the three years he would like the Town to get custody of this money. There is $1,353,721.00 in the account. We are paying a fee for them to invest the money and it is eating up a lot of our interest. Attorney Auffredou suggested that Supervisor Gutheil start with GE and see where it goes from there.
Mike Shaver reported that the highest daily water usage so far has been 970,000 gallons.
Supervisor Gutheil reported receiving another telephone call from a credit company regarding an outstanding Tru-Green bill and he asked them not to call again and explained again to them that this is a disputed bill.
