A Public Hearing was held by the Town Board of the Town of Moreau on June 10, 2003 in the Town Office Building, 61 Hudson Street, South Glens Falls, New York, for the purpose of considering a petition received for the creation of a lighting district in the Sherwood Forest Subdivision.

Supervisor Gutheil opened the Public Hearing at 6:52 p.m.

The Town Clerk called the roll, which resulted in the following Town Board Members being present or absent:

The Town Clerk read the following Order that was noticed in the legal section of the Post Star on May 31, 2003:

ORDER

REGARDING PROPOSED

LIGHTING DISTRICT

WHEREAS, the Town Board of the Town of Moreau was presented with a petition pursuant to Town Law Article 12 for the establishment of a Lighting District located in the Sherwood Forest subdivision on the south side of William Street, Town of Moreau, Saratoga County, State of New York to be known as the Sherwood Forest Lighting District, and

WHEREAS, the petition was filed by the sole owner of taxable real property located within the proposed Lighting District; and

WHEREAS, according to Niagara Mohawk Power Corporation there are no costs associated with the installation of lights in the lighting district only monthly billing; and

WHEREAS, according to Niagara Mohawk Power Corporation a total of nine (9) one hundred watt high-pressure sodium lights will be installed in the lighting district; and

WHEREAS, according to Niagara Mohawk Power Corporation the lights will be no higher than sixteen feet and will be architectural in design, and

WHEREAS, according to Niagara Mohawk Power Corporation the yearly billing charge for the aforesaid one hundred watt high-pressure sodium lights is approximately $2,856.47; and

WHEREAS, no dollars are proposed to be expended for improvements; and

WHEREAS, the Town Board of the Town of Moreau shall meet on June 10, 2003 at 6:50 p.m. to consider the aforesaid petition and to hear all interested persons.

NOW, THEREFORE, by resolution of the Town Board of the Town of Moreau, it is hereby ordered:

    1. That the Town Board shall meet at the aforesaid time and place to consider the petition for the creation of a lighting district with the Sherwood Forest subdivision; and
    2. A copy of this Order, certified by the Town Clerk, is to be published at least once in the Post Star, the first publication thereof to be not less than ten (10) and no more than twenty (20) days before the day set herein for the hearing as aforesaid; and
    3. A copy of this Order shall be posted on the sign board at the Town of Moreau Town Hall not less than ten (10) and no more than twenty (20) days before the day designated for the hearing as aforesaid; and
    4. A detailed explanation of how the estimated cost of hook-up fees, if any, to and the cost of the lighting district’s extension to, the typical property and, if different, the typical on or two family home was computed is to be filed for public inspection with the Town Clerk.

Supervisor Gutheil asked if anyone present wished to be heard for or against the proposed lighting district.

A resident of Sherwood Forest Lighting District commented that based on the estimated cost for the proposed lights he calculated that the cost for each of the nine lights would be $312.00 per year. He asked if didn’t the Board feel this was a little high?

Supervisor Gutheil advised that the district would be leasing the wires and poles and the whole thing, it isn’t just the cost of power. The Town would have to sign a contract with the utility company.

The resident said this made more sense then. He thought the developer was putting in the lights. He didn’t have any objections to the creation of the lighting district.

Supervisor Gutheil asked if anyone else wished to be heard for or against the proposed lighting district.

There being no further comments Supervisor Gutheil closed the Public Hearing at 6:56 p.m.
