The regular meeting of the Zoning Board of Appeals for the Town of Moreau, Saratoga County, and State of New York was held at the Moreau Town Hall, 61 Hudson Street, South Glens Falls, NY 12803 on November 29, 2006 at 7:00 p.m. with the following members present or absent:

Darrell Finlayson

Others present: F. Joseph Patricke, Building Inspector

The meeting was called to order at 7:04 and the October 25, 2006 minutes were reviewed. Mr. Joslin motioned to accept the minutes with a revision to the second to last paragraph and Mr. Finlayson seconded. The motion passed unanimously.

The Board then reviewed Appeal No. 661, a request of Bob and Debbie Hanson of 6 Tanglewood Drive, South Glens Falls, NY 12803 for an Area Variance pursuant to Chapter 149, Article X, Section 149-59(A) and Town Law 267-b. The applicants are requesting to construct a front porch that will not meet the required front yard setback for an R-2, One and Two Family Residential District and is designated as 49.19-2-24 on the Town Assessment Map.

The applicant stated that the porch is 8 ft by 24 feet. Mr. Patricke told the Board that the houses in that neighborhood are all built close to the road and there is no other way to add a desirable covered front porch than to ask for a variance.

Mr. Joslin asked and was told that the distance from the porch to the waterline shown on the drawing is about 15-20 feet, with a fair sized tree in between. There is no other location for the porch as they have lined it up with the door and avoided the driveway.

The Board determined that a 10 foot variance would be more appropriate since the applicant was not sure if the measurements allowed for an overhang. The variance will go to the nearest point.

There was no correspondence or public comment.

The Board reviewed the criteria for granting an Area Variance and found as follows:

    1. There would be no adverse effect on the character of the neighborhood.
    2. There are no other feasible means of achieving the desired benefit.
    3. The variance is not substantial.
    4. The Board did not identify any adverse environmental impact.
    5. The difficulty was not self-created.

Mr. Joslin motioned to approve Appeal No. 661 for a ten foot variance from the front yard setback and Mr. Finlayson seconded.

A roll call vote resulted as follows:

Mr. Finlayson Yes

Mr. Joslin Yes

Chairman Endal Yes

Motion carried and Appeal No. 661 was approved.

The Board reviewed Appeal No. 662, a request of Fletcher T. Finke, Bobcat of Saratoga LLC of 1279 Route 9, Gansevoort, NY 12831 for a Special Permit pursuant to Chapter 117, Section 117-4(B) of the Code of the Town of Moreau. Applicant is requesting erect a sign on the façade of the building that will exceed the maximum square footage allowed by the code. This property is located in a C-1, General Commercial District and is designated as 77.1-1-45 on the Town Assessment Map.

Mr. Finlayson motioned to continue the appeal since the applicant was not present. Mr. Joslin seconded and the appeal was continued.

The next meeting was scheduled for December 27, 2006. The meeting was adjourned at 7:21 p.m.
